Terms of Service

AgentBuddy is in early access. Features, pricing and these terms are still evolving and may change as the product develops. We will post any material changes here.

1. Who we are

AgentBuddy ("AgentBuddy", "we", "us", "our") is an AI office-manager service for New Zealand trades and small businesses, operated from New Zealand. You can reach us at [email protected]. By creating an account, registering your interest, or using the service, you agree to these terms.

2. The service

AgentBuddy uses artificial intelligence to help you run the admin side of your business, for example answering calls, drafting quotes from a photo or voice description, sending invoices, chasing payments and following up leads. The exact features available to you depend on your plan and may change over time.

3. AI output is a starting point, not gospel

AgentBuddy is powered by AI. AI can make mistakes, misunderstand instructions, or produce inaccurate or incomplete results. You are responsible for reviewing anything AgentBuddy produces, before you rely on it or send it to a customer, including quotes, prices, invoices, GST amounts, messages and bookings. AgentBuddy does not provide legal, accounting, tax or financial advice.

4. Your account

You must give accurate information and keep your login details secure.
You are responsible for activity under your account and for your team members' use.
You must be at least 18 and using AgentBuddy for a business or trade.

5. Free trial, pricing and billing

Plans start with a free trial as described at sign-up. You can cancel any time during the trial and you will not be charged.
After the trial, fees apply at the plan rate shown on our pricing page. Prices are in New Zealand dollars and are exclusive of GST unless stated otherwise.
Subscriptions renew automatically (monthly or annually) until cancelled. You can cancel before the next renewal to avoid the next charge.
Except where required by law, fees already paid are non-refundable. We may change pricing on reasonable notice; changes take effect at your next renewal.

6. Acceptable use

You agree not to use AgentBuddy to break the law, to send spam or unlawful communications, to harass anyone, to infringe others' rights, or to attempt to disrupt, reverse engineer or gain unauthorised access to the service. You must make any disclosures and get any consents required by law (for example, for recording calls) before using related features.

7. Your content and data

You keep ownership of the information and content you put into AgentBuddy and the content it generates for you. You grant us a licence to host and process that content so we can provide the service. Our handling of personal information is set out in our Privacy Policy.

8. Third parties

AgentBuddy relies on third-party providers (for example AI model providers, hosting, analytics and any payment processor). Their services may have their own terms, and outages or changes on their side can affect AgentBuddy.

9. Availability and warranties

We work hard to keep AgentBuddy running but provide it on an "as is" and "as available" basis and do not guarantee it will be uninterrupted or error-free. Where you use AgentBuddy for the purposes of a business, you agree that the Consumer Guarantees Act 1993 does not apply, to the extent the law allows you to contract out of it. Nothing in these terms limits rights you have under the Fair Trading Act 1986 or other rights that cannot lawfully be excluded.

10. Limitation of liability

To the extent permitted by law, we are not liable for indirect or consequential loss, lost profits, lost revenue, or loss of data or goodwill. Our total liability arising out of or in connection with the service is limited to the fees you paid us in the three months before the event giving rise to the claim.

11. Suspension and termination

You can stop using AgentBuddy and cancel at any time. We may suspend or end your access if you breach these terms, if required by law, or if we discontinue the service. On termination, your right to use the service ends; we may delete your data after a reasonable period (see the Privacy Policy).

12. Changes to these terms

We may update these terms from time to time. If we make material changes we will update the date above and, where appropriate, let you know. Continuing to use AgentBuddy means you accept the updated terms.

13. Governing law

These terms are governed by New Zealand law, and the New Zealand courts have non-exclusive jurisdiction over any dispute.
